|ORS4 1488 Covid-19 Recovery:Extension of Validity Periods of TK Examinations and Training for the Issue of Licences and Type Ratings|
This exemption will enable the extension of validity periods of theoretical knowledge examinations currently being undertaken or completed as part of training courses for flight crew licences, ratings, and certificates delivered in compliance with Annex 1 of the Aircrew Regulation.
In this exemption, references to EU regulations are to those regulations as retained and amended in UK domestic law under the European Union (Withdrawal) Act 2018 and are referenced as “UK Regulation (EU) year/number” or “UK Regulation (EU) No. number/year”.
The Civil Aviation Authority, pursuant to Article 71(1) of UK Regulation(EU) 2018/1139,exempts pilots under training for the issue of a UK Part-FCL licence from the requirements of Annex 1, FCL.740(a),of UK Regulation(EU) No. 1178/2011 applicable to individuals completing examinations or training, subject to the conditions specified below.
a. All theoretical knowledge examinations candidates under FCL.025(b)(2)whose examinations were due to expire between 19 March 2020 and 31 May 2021 are granted an additional 6 months to complete their examinations until 30 November 2021.
b. All theoretical knowledge examinations candidates under FCL.025(b)(2)where the candidate examinations were affected by COVID-19 between 19 March 2020 and 31 May 2021, and whose examination are due to expire in the month as shown in the table Annex 1 under original completion month are granted additional time as shown in the table Annex 1.
c.All theoretical knowledge examinations candidates under FCL.025(b)(2) where the candidate has commenced the examination process during the period of 19 March 2020 and 31 May 2021 are granted additional time as shown in the table Annex 2.
d. All candidates whose theoretical knowledge examinations validity period under FCL.025(c)(1)(i)and (ii) spanned the period of 19 March 2020 and 31 May2021are granted an additional 6 months to the standard24 monthsfor a non-commercial licence,or 36 months for a commercial licence,instrument rating (IR) or en route instrument rating (EIR), to complete their flight training hours.
e. The validity periods specified in FCL.725(c) completed until 31 May 2021 shall be extended by 6 months regarding the following:
i. the 6-month period between the commencement of the type or class rating training course and the passing of the skill test; and
ii. the 6-month period between the passing of the skill test and the application for the issue of the class or type rating.
f. The period specified in any of the following, if current validity ends between 16 March 2020 and 31 May 2021inclusive,shall be extended by 6 months:
iii) Part-FCL Appendix 3 Section H(1)(ATP Modular Course –Helicopters);
iv) FCL.810(a)(1)and (b)(2) (Night Rating).
g. AirlineTransport Pilot Licence theory examinations that were due to expire at the 7-year point from the expiry of the Instrument Rating on or after 16 March 2020 but before 31 April 2021 in accordance with FCL.025(c)(2)(i), are extended until 30 November 2021.
Applicants fora licence, rating or certificate benefiting from this exemption shall receive further training determined by the DTO or the ATO based on the needs of the applicant. Any such further training shall be recorded in the applicant’s training record.
This exemption supersedes Official Record Series 4 No.1464 which is hereby revoked.Date in Force.
This exemption has effect from the date it is signed until31 May 2023, both dates inclusive, unless previously revoked.
